These are the terms and conditions that apply when you purchase products from Eminentia Trading Limited, a company duly incorporated and existing in accordance with the laws of the Republic of Cyprus under registration number HE32582 and head office at Prodromou 53, Apartment 1, Nicosia 1090, Cyprus , trading under the brand name Thermomix Cyprus from our online store. In these terms and conditions, the words “we”, “our” or “us” refer to Eminentia Trading Limited. Our VAT registration number is 1032582J.
We only sell and transport products within the Republic of Cyprus.
2.1 Our displayed product prices are in Euro and include VAT, unless otherwise stated.
2.2 Our displayed prices exclude shipping and handling costs which will be added to the total price of your order.
2.3 Our displayed prices may change from time to time.
3.1 We regularly update our online shop. We will do our best to ensure, but cannot promise, that the information displayed in our online shop will always be correct.
3.2 Our online shop includes images for illustrative purposes, but we cannot promise that any image will always reflect or portray the full design or options relating to that product.
4.1 You must be at least eighteen years of age to place an order in this online shop.
4.2 Registration is not required prior to submitting an order through this online shop but it is recommended for your convenience. By setting up an account at our shop, you will be able to proceed faster with your payment process, track your orders in your account, and more. See section 11 for details on how to register.
4.3 You may place your order by clicking on the ‘Add to Cart’ button below the products of your choice in this online shop. Once your selected products are in your virtual “shopping cart”, click on the ‘Check Out’ link and follow the on-screen instructions to complete your purchase. When you place your order and payment is received, we will email you a confirmation of your order details. Ordering through our online store requires a valid email address and phone number.
4.4 By placing an order, you make an offer to us to purchase the products you have selected based on these terms.
4.5 We will notify you that your order is being processed by sending you an ‘Order Confirmation’ indicating that the products have been fully paid by email. If we are unable to process or accept your order after receiving the payment, we will contact you by email or phone.
4.6 We will confirm the shipment of the products you have ordered by sending an SMS-type message from the courier of our choice.
5.1 We currently accept Visa, Mastercard and JCB.
5.2 We process credit card payments after placing an order in accordance with clause 4.
5.3 For security reasons we reserve the right to decline any credit cards issued by banks outside the Republic of Cyprus.
5.4 You may need to provide further identification for additional security reference checks.
6.1 Shipping costs will be displayed after selecting the delivery point of your products upon completion of your Order at the checkout.
6.2 Shipping costs may change from time to time. Shipping costs are influenced by the size and weight of your products and your location. Delivery times are estimated at between 1-3 working days once dispatched, depending on your location within the Republic of Cyprus.
6.3 We will endeavour to process all orders on this online store within three working days, however, due to circumstances out of our control, delays may occur. If there are any unforeseen delays, we will contact you.
6.4 All orders will be shipped to you by a courier service of our choice.
6.5 All risk of loss or damage of the products passes to you upon dispatch of the products.
7.1 We hope that you will be happy with the product(s) you ordered. However, if for any reason you wish to return them, or to cancel your order prior to the product(s) being dispatched, you must notify us in writing by whichever is the later of:
7.1.1 Within two (2) hours of placing your order, or
7.1.2 Within fourteen (14) calendar days of receiving the product, or the last product, where your Order was for multiple products.
7.2 Any written statement must be communicated to us by letter to Eminentia Trading Ltd, Prodromou 53, Apartment 1, 1090 Nicosia or via email at info@eminentia.com.cy
7.3 Notice of cancellation is deemed received when:
7.3.1 by first class mail: at 9:00 am on the second working day after posting.
7.3.2 by email: 24 hours from delivery if sent to the correct email address and no notice of delivery failure is received.
7.4 Upon receipt of your written statement, we will confirm your cancellation in writing.
7.5 Once your cancellation has been confirmed in writing by us, we will refund to you the price paid. This includes any delivery charges unless your order has already been shipped with the courier. We will refund without undue delay and not later than:
7.5.1 fourteen (14) calendar days after the day we receive back from you the product(s) supplied, or
7.5.2 if there were no product(s) ever dispatched, fourteen (14) calendar days after the day on which you inform us of your decision to cancel this contract.
7.6 It is understood that products that have already been opened and / or used are not eligible for a refund.
7.7. Our Right to Cancel Your Order: We may need to cancel an order prior to delivery of the Products due to some force majeure event or stock unavailability. If this happens, we will contact you immediately to let you know, and if you have made any advance payment for products that have not been delivered to you, we will refund those amounts.
Our products come with consumer guarantees. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage that has been proven that it happened during the shipping of the Products and in any event before you receive them. You also have the right to have the products repaired or replaced if the products failed to be of acceptable quality and the failure does not amount to a major failure.
Please ensure that you open your parcel and check that all products are included and are undamaged. If you believe that the products were damaged in transit or are defective, please contact us as soon as possible.
We do not offer refunds if you simply change your mind. Consumer guarantees may also not apply if the products are damaged due to abnormal use.
Whilst reasonable efforts are made to protect the security of transmission of information over the Internet, we do not guarantee or warrant that any transmission of any data over the Internet is completely secure. Consequently, any information that you transmit to us is transmitted at your own risk. Once we receive your transmission, we will take reasonable steps to keep this information secure.
We will use the personal information you provide to Us to:
provide the Product(s);
process Your payment for such Product(s).

13.1 If any part of these terms is deemed invalid, illegal or unenforceable then this part will be deemed to be severable from the other terms and the severed shall not affect the validity and enforceability of any of other terms.
13.2 All terms are governed by and construed in accordance with the laws of the Republic of Cyprus.
13.3 Any disputes that may arise from these terms are in the sole jurisdiction of the competent courts of the Republic of Cyprus.
